Terms and Conditions
All LinuxCertified laptops,
bought online, over phone or through a reseller are subject to
following terms and conditions.
By accepting these Terms and Conditions while placing your order, you ("Customer") agree to be bound by the terms and conditions listed below. You and LinuxCertified, Inc. agree that the following terms and conditions are the exclusive terms governing the sales transaction between Customer and LinuxCertified, Inc. Any attempt to alter, supplement, modify or amend these terms and conditions by the Customer will be considered a material alteration of this agreement and, therefore, are null and void. In addition, these terms and conditions are subject to change at any time, without prior written notice. Therefore, please check these terms and conditions carefully each time you place an order with LinuxCertified, Inc.
All advertised prices are in U.S. dollars and, unless otherwise noted, exclude shipping, handling and any taxes that may be imposed by the legal authority that governs the jurisdiction in which you reside. LinuxCertified, Inc is not responsible for pricing, typographical or other errors in any offer by LinuxCertified, Inc and we reserve the unilateral right to cancel any orders resulting from such errors.
Taxes: Unless otherwise indicated on the invoice, you are responsible for paying all taxes, Import duties, clearance and other charges associated with your order.
Applicable Law & Not for Resale: You agree and represent that you are buying the products governed by this Agreement for your own use and not for resale.
Export: You acknowledge that the purchased goods licensed or sold under this agreement, and the transaction contemplated by this agreement, which may include technology and software, are subject to the customs and export control laws and regulations of the United States, and may also be subject to the customs and export laws and regulations of the country in which the products are received. Further, under United States law, the goods shipped pursuant to this Agreement may not be sold, leased, or otherwise transferred to restricted countries or utilized by restricted end-users or an end-user engaged in activities related to weapons of mass destruction, including activities related to the design, development production or use of nuclear weapons, materials, facilities, missiles or the support of missile projects, and chemical or biological weapons.
LinuxCertified, Inc has not tested product for use in high-risk activities including any life sustaining, chemical, or mission critical use. LinuxCertified, Inc will not have any LIABILITY for any damage arising from the use of the product in any high risk activity. including Aircraft Navigation, or Communication Systems, Medical or Life Support Systems.
Governing Law: This Agreement and any sales hereunder shall be governed by and construed in accordance with the laws of the State of California. Any litigation under this agreement shall be resolved in the trial courts of Santa Clara County, State of California, which shall have exclusive jurisdiction on this matter.
Return policy on items purchased:

Please return the item with a
statement as to why the item has been returned (wrong item shipped,
damaged item, etc.).
If the wrong item has been
shipped, the correct item will be shipped to you as soon as the item is
received back at LinuxCertified.
If the item has been damaged, a
substitute item will be shipped to you.
For permanent returns, a credit
will be issued when the item is received back for the amount that the
item sold was for MINUS THE SHIPPING COST. All products returned for
credit are subject to a 15% restocking fee before credit is issued. No returns or exchanges on
opened software. No returns or exchanges on physically damaged
products. In no circumstance, will a return for credit will be accepted
after 15 days of shipping of a product.
It is your responsibility to ensure that the item returns back to us.
No refund will be made until the item is received.
Special note for customers buying
laptops with Windows XP or Windows 7 (e.g. dual boot configuration): If you need to
return the laptop for any reason, we cannot take a return of MS Windows
XP or MS Windows 7. Please keep the OS CD and the key sticker. This is because of the
licensing constraints placed by Microsoft.
For customers outside USA: Returns will be charged
a $50 customs-handling fee.
Order Cancellation policy:
As all the orders are customized orders, once the order is placed we incur irreversible fees and costs therefore all order cancellations Before it has been shipped is subject to a 15% cancellation fee before credit is issued.

Dead pixel policy:
In line with industry standards
LinuxCertified maintains a fair policy regarding dead/bad pixels. E.g.
this is an excerpt from Apple's website:
"With the millions of subpixels on
a display, it is quite possible to have a low number of faulty
transistors on an LCD. Therefore, a certain number of subpixel
anomalies is considered acceptable. Rejecting all but perfect LCD
panels would significantly increase the retail price for products using
In general we assume a LCD to be
acceptable as long as it has four or less bad pixels. Individual cases
can certainly be reviewed, e.g. if all of these bad pixels are
clustered right at the center of the screen.
Unless specifically mentioned, all
Linux laptops will ship with downloaded/copied CDs version of the Linux
Support and Limited Warranty:
The support for laptops is limited
to hardware and drivers of core hardware components. Although, in
general, we do help out customers with Linux configuration issues, we
will restrict the number of such incidents that we support. We only
support drivers with default distribution kernels. LinuxCertified provides no warranty for the third-party
software included with the product or installed by the customer.
It is customers responsibility to figure out whether an external
peripheral (e.g. a scanner, printer, camera etc.) will work with Linux
and with the specific distribution being sent with their laptop. The
only exception to this is if the external peripheral was bought through
LinuxCertified, with express written statement of Linux support for
that particular peripheral.
Warranty: This Limited Warranty only covers
product issues caused by defects in material or workmanship
during ordinary consumer use; it does not cover product issues
caused by any other reason, including but not limited to product
issues due to misuse, mishandling, limitations of technology,
or modification of or to any part of the LinuxCertified product.
This Limited Warranty is invalid if the factory-applied serial
number has been altered or removed from the product. It is
your responsibility to inform us of the product issue before
the end of your product's warranty period. The product needs
to be shipped to us for repair by the last day of your product's
warranty period. The warranty does not cover software or data
loss occurring during repair or replacement.
Please note that hardware warranty on Lenovo
Thinkpads is provided directly by Lenovo. Customers need to
communicate with Lenovo on all hardware related issues on
EXCEPT AS PROVIDED IN THIS WARRANTY AND TO
THE EXTENT PERMITTED BY LAW, LINUXCERTIFIED IS NOT RESPONSIBLE FOR
DIRECT, SPECIAL, INCIDENTAL OR
CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR
CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED
TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS
(INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY;
LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY;
LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO OR CORRUPTION
OF DATA; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER
CAUSED INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS
OF RECOVERING, PROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA STORED
OR USED WITH LINUXCERTIFIED PRODUCTS AND ANY FAILURE TO MAINTAIN THE
CONFIDENTIALITY OF DATA STORED ON THE PRODUCT. LINUXCERTIFIED
REPRESENTATION THAT IT WILL BE ABLE TO REPAIR ANY PRODUCT UNDER THIS
WARRANTY OR MAKE A PRODUCT EXCHANGE WITHOUT RISK TO OR LOSS OF THE
PROGRAMS OR DATA.
When you contact us, we will issue a Return Material Authorization
(RMA) Number for you to include with your return. A RMA number is valid
for 15 days from the day we send it to you. You must return the
products to us in their original or equivalent packaging, prepay
shipping charges, and insure the shipment or accept the risk if the
product is lost or damaged in shipment. We will return the repaired or
replacement products to you. We will pay to ground ship the repaired or
replaced products to you if you use an address in the United States
(excluding Puerto Rico and U.S. possessions and territories).
Otherwise, we will ship the product to you freight collect.
LinuxCertified reserves the right
to return freight collect, Products (i) that are not covered by our
warranty; or (ii) for which there is no trouble found. Products
delivered to LinuxCertified with an expired RMA may be refused and
returned to the customer freight collect.
If we determine that the problem
is not covered under this warranty, we will notify you and inform you
of service alternatives that are available to you on a fee basis.
Repaired units may require
re-loading of original factory software. It is recommended that
customers back-up any important data before sending in unit for repair.
The warranty period is not
extended if we repair or replace a warranted product or any parts.
Laptop battery: Extended
warranties on laptops do not include the battery. In general it is very
difficult to be deterministic about battery life. Exact same battery
model on two units of same laptop model may give completely different
results based on use. A reduction in battery life over time is deemed
normal. We will replace a battery if the uptime of your laptop drops by
more than 50% within first 90 days of use. For rest of the warranty
period (limited to one year), a battery will be replaced only if
battery life goes below 25% as compared to a new laptop of the same
For customers outside USA: In certain cases
(if the issue is reported within first 30 days after receiving
the laptop) LinuxCertified may pay for shipping charges for
returning the repaired systems, but you will be responsible
for any customs or brokerage fees incurred in the process.
